New York State law requires employers to provide updated written notice of pay changes using the correct LS form. Not sending these forms can result in compliance violations or penalties.

If an employee’s tax work location is in New York State, you are required to provide written notice any time you:

  • Add or change an hourly or salaried pay rate

  • Add additional pay rates (such as for different job roles)

  • LS 54: For hourly (non-exempt) employees

  • LS 59: For salaried (exempt) employees

LS 54 and LS 59 compliance

After saving changes to an employee’s pay rate:

  • A prompt will appear asking if you'd like to send the appropriate form for signature.

You have two options to get the LS 54 or LS 59 to your employees:

  1. Send email now (recommended): We will send either the LS 54 or LS 59 based on the employee’s pay type, hourly or salary, to the employee’s email on file.

    1. You will get a confirmation pop-up informing you that the document will be emailed to the current email address on file, and the address will be displayed for you to confirm.

      1. If the employee's address is incorrect or missing, you can either update their profile with their email address or re-generate the document and send it to the correct email address via HR > Documents > Generate Form.

    2. This helps streamline compliance by ensuring that your employee has received the correct form to be signed electronically at the same time as the pay rate change.

2. Download: Download the form at the time of rate change, or you can generate and send the form later from HR > Documents > Generate Form in the employee's profile.

  • You can edit the form after it has been downloaded before sharing it with your employee.

After downloading the LS 54 or LS 59 form as a PDF, you can edit it before sending it to your employee for signatures. The document will open in PDF format, complete with your pre-filled information as well as interactive checkboxes and fields in multiple languages.

Generate the LS 54 or LS 59 form

To remain compliant, you must provide the appropriate form to the employee either by email or by downloading a physical copy.

  1. Go to the employee’s profile.

  2. Navigate to HR > Documents

  3. Click Generate Form.

4. Select LS 54 (hourly) or LS 59 (salaried) based on the employee’s pay type.

5. Choose either to email for an e-signature or download the form for a physical signature.

Note: To check whether the document was signed, navigate to Employee > HR > Documents to check the status.
